Drug cultivation charges carry significant penalties in Sydney, reflecting the seriousness of the offence. These penalties vary based on the quantity of the prohibited plant and the court handling the case. Here’s a breakdown:

  • Small Quantity: In Local Court, penalties can include up to 2 years imprisonment and/or a $5,500 fine. In District Court, this escalates to 10 years imprisonment and/or a $220,000 fine.

  • Indictable Quantity: The same penalties as Small Quantity apply, with 2 years imprisonment and/or $11,000 fine in Local Court and 10 years imprisonment and/or $220,000 fine in District Court.

  • For larger quantities, the matter escalates beyond Local Court, with penalties reaching up to 15 or 20 years imprisonment and fines of $385,000 or $550,000, respectively.
